This Non-Liability Waiver ("Waiver") outlines the limitations of liability for EZ Boat ("Company") and the responsibilities of users of the EZ Boat platform ("Users"), including but not limited to boat owners, renters, captains, crew, and service providers. By accessing or using the EZ Boat platform, you ("User") agree to the terms of this Waiver. If you do not agree, you must cease use of the platform immediately.

1. Facilitation Role of EZ Boat

  • EZ Boat is a platform that facilitates connections between Users for boating-related services, including but not limited to vessel rentals, charters, and other marine services.
  • EZ Boat does not own, operate, manage, or control any vessels, captains, crew, or services offered on the platform.
  • All transactions and agreements are conducted solely between Users. EZ Boat is not a party to these agreements and assumes no responsibility for the performance or outcome of any transaction.

2. Assumption of Risk

  • By using the platform, Users acknowledge and accept that boating activities inherently involve risks, including but not limited to physical injury, property damage, and financial loss.
  • Users agree to voluntarily assume all risks associated with their transactions, activities, and interactions with other Users, including risks arising from negligence or failure to adhere to safety protocols.


3. Disclaimer of Liability


EZ Boat disclaims all liability for:

  • Vessel Safety: The safety, maintenance, or seaworthiness of any vessel listed on the platform.
  • User Conduct: The actions, behavior, or qualifications of any User, including boat owners, renters, captains, crew, or service providers.
  • Accidents or Injuries: Any injuries, deaths, or property damage occurring during boating activities facilitated through the platform.
  • Compliance with Laws: The legal compliance of Users with local, state, or federal regulations, including licensing, safety requirements, or insurance coverage.
  • Financial Losses: Any financial losses resulting from cancellations, disputes, or failed transactions.

4. User Responsibilities

  • Due Diligence: Users are solely responsible for verifying the safety, qualifications, and compliance of other Users with applicable laws and regulations.
  • Insurance Coverage: Users must ensure they have adequate insurance coverage for their vessels, activities, and personal liabilities.
  • Safety and Compliance: Users must adhere to all applicable safety regulations and laws during their activities.
  • Dispute Resolution: Users agree to resolve disputes directly with one another without involving EZ Boat.

5. Indemnification


Users agree to indemnify, defend, and hold harmless EZ Boat and its affiliates, officers, directors, employees, agents, and representatives from any claims, demands, liabilities, damages, or expenses (including attorneys' fees) arising out of or related to:
 

  • User negligence, misconduct, or violation of these terms.
  • Property damage, personal injury, or death occurring during activities arranged through the platform.
  • Non-compliance with applicable laws or regulations.

6. No Warranty

  • EZ Boat provides its platform on an "as-is" and "as-available" basis without warranties of any kind, express or implied.
  • EZ Boat does not guarantee the accuracy, reliability, or suitability of any content, services, or Users on the platform.
  • EZ Boat does not warrant uninterrupted or error-free access to its platform.

7. Release of Claims

  • Users agree to release, waive, and discharge EZ Boat from any and all claims, liabilities, or causes of action arising from:
    • Injuries, damages, or losses occurring during activities facilitated through the platform.
    • Disputes, misunderstandings, or dissatisfaction with other Users or services.

8. Limitation of Liability

  • In no event shall EZ Boat or its affiliates be liable for direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, goodwill, data, or other intangible losses resulting from:
