EZ Boat is committed to providing a safe and reliable platform for boating enthusiasts, renters, captains, and service providers. This Vessel Safety and Compliance Policy ("Policy") outlines the requirements and expectations for all vessels listed on the Platform to ensure compliance with safety standards and maritime laws. By listing or using a vessel through EZ Boat, all users agree to the terms of this Policy.
1. Minimum Safety Equipment Requirements
All vessels listed on EZ Boat must meet the following minimum safety equipment standards, in accordance with local maritime regulations:
- Life Jackets/PFDs: Adequate personal flotation devices for all passengers onboard, meeting U.S. Coast Guard (USCG) or equivalent international standards.
- Fire Extinguishers: Fully charged and properly maintained fire extinguishers suitable for the vessel type.
- Signaling Devices: Visual distress signals (e.g., flares) and sound-producing devices (e.g., horn or whistle).
- Navigation Lights: Functioning lights for safe operation during nighttime or low-visibility conditions.
- Throwable Floatation Devices: At least one throwable device (e.g., life ring) as required by law.
- Anchor and Line: Proper anchoring equipment suitable for the vessel's size and operating environment.
- First Aid Kit: A fully stocked first aid kit designed for maritime use.
- Bilge Pump/Manual Bailer: Operational bilge pump or manual bailing device for water removal.
- Emergency Communications: A functioning VHF radio or equivalent communication device.
Failure to meet these requirements may result in the vessel being delisted or bookings being canceled.
2. Compliance with Local Maritime Laws
Boat owners, captains, and service providers are responsible for ensuring that their vessels comply with all applicable local, state, and federal maritime laws and regulations, including but not limited to:
- Proper registration and display of registration numbers.
- Adherence to environmental laws, including fuel handling, waste disposal, and wildlife protection.
- Compliance with capacity limits as indicated on the vessel's certification plate.
- Alcohol and drug policies in accordance with local and maritime law.
3. Inspections and Certifications
- Initial Listing: Vessel owners must confirm that their vessels meet EZ Boat’s safety standards during the listing process.
- Ongoing Inspections: EZ Boat reserves the right to request updated inspection reports or certifications to ensure continued compliance.
- Professional Certifications: Certain vessel types (e.g., yachts or commercial vessels) may require proof of professional inspection or certification by recognized authorities, such as the USCG, MCA, or other relevant agencies.
4. Owner Responsibility for Seaworthiness
Vessel owners are solely responsible for maintaining the seaworthiness and operability of their vessels, including:
- Performing regular maintenance and repairs to ensure the vessel operates safely and reliably.
- Addressing any mechanical or structural issues prior to a booking.
- Confirming that all onboard systems, including propulsion, electrical, navigation, and safety systems, are in proper working order.
- Keeping the vessel clean and free of hazards that could endanger passengers or crew.
5. Verification and Reporting
- Verification Process: EZ Boat may require documentation, including photographs, inspection reports, or proof of compliance with safety standards, to verify a vessel's eligibility for the Platform.
- User Reporting: Renters, captains, or other users can report vessels they believe are non-compliant or unsafe. EZ Boat will investigate such reports and may suspend or remove the vessel from the Platform if necessary.
6. Non-Compliance and Penalties
- Vessels found to be non-compliant with this Policy or applicable laws may be subject to immediate suspension or removal from the Platform.
- EZ Boat reserves the right to cancel bookings, withhold payments, or pursue other actions to protect user safety and maintain trust within the community.
7. Disclaimer
EZ Boat acts solely as a facilitator for connecting users and does not independently verify the safety or compliance of listed vessels. Users are responsible for exercising due diligence and inspecting vessels prior to use. EZ Boat disclaims all liability for accidents, injuries, or damages arising from the use of non-compliant vessels.
8. Updates to the Policy
EZ Boat reserves the right to update or modify this Policy at any time. Changes will take effect immediately upon posting on the Platform. Continued use of the Platform constitutes acceptance of the updated Policy.
